These terms and conditions apply to orders placed through the LIV MAKES webshop.
Please read these terms carefully before placing an order.
1. About LIV MAKES
LIV MAKES offers, among other things, creative painting kits, personalized products, party and treat products, Party Keepsakes, gifts and handmade decoration.

The LIV MAKES webshop is provided through Shopify.
2. Applicability
These terms and conditions apply to agreements concluded through the LIV MAKES webshop.
Before placing an order, you can view and save these terms and conditions.
If a provision in these terms and conditions conflicts with mandatory Dutch or European consumer law, the applicable statutory provisions will take precedence.
3. Product information
We do our best to describe the main characteristics of our products, including contents, materials, colors and dimensions, as clearly and accurately as possible.
Colors may differ slightly from the actual colors due to screen settings and photography.
Many LIV MAKES products or components are handmade, including plaster figures, Jesmonite products and handmade wall decoration.
Handmade products may show small differences in, for example, color, texture, shape, placement and finish. Cast materials may also contain small surface air bubbles or other characteristics inherent to the material.
Such minor variations do not in themselves constitute a defect, provided they do not affect the safety, functionality or characteristics that you may reasonably expect based on the product description.
The product page specifies the contents, materials, dimensions, options and relevant usage and safety information for the respective product.
4. Creative products and safe use
Our creative products may include plaster figures, acrylic paint, brushes, canvas, paint palettes, aprons, hanging materials and other creative components.
Before use, always check the instructions, age recommendations and warnings provided on the product page, packaging and any included instructions.
Where adult supervision or assistance is indicated for a product, the product must be used accordingly.
Paint, plaster and other craft materials are not intended for consumption.
Use products only for their intended purpose and in accordance with the provided instructions.
Nothing in this section limits LIV MAKES’ statutory obligations regarding product safety or the statutory rights of consumers.
5. Orders and conclusion of the agreement
When you place an order through our webshop, you provide the information and selections required to fulfil the order.
After completing your order, you will receive an electronic order confirmation.
We may refuse or cancel an order where there is a justified reason, for example when:
> a product is unexpectedly unavailable;
> payment cannot be processed;
> necessary information is missing or clearly incorrect;
> there is an obvious pricing, text or product error;
> there is a reasonable suspicion of fraud or misuse.
If we are unable to fulfil an order that has already been paid for, we will inform you and refund the relevant amount paid.
6. Prices and payment
All consumer prices are shown in euros.
LIV MAKES currently participates in the Dutch Small Businesses Scheme (Kleineondernemersregeling – KOR). Under this scheme, LIV MAKES does not charge VAT to customers and VAT is therefore not separately included or stated on our prices or invoices.
Any shipping costs and other mandatory additional charges are shown before you complete your order.
The available payment methods are displayed during checkout.
The price shown for the order applies, except in the case of obvious errors.
We may change prices, promotions and our product range for future orders. Such changes do not affect agreements that have already been concluded.
7. Personalized products
Some LIV MAKES products are made according to your choices or specifications. This may include, for example:
> a name made from plaster letters;
> a personalized name sign;
> a name, age or text on a product or packaging;
> a version made specifically for you.
Before completing your order, carefully check all information you have entered, including names, spelling, ages and other personalization details.
LIV MAKES produces the product based on the information provided with the order.
If LIV MAKES itself makes an error in carrying out the agreed personalization, your statutory rights remain applicable.
Right of withdrawal for personalized products
For products made according to your specifications that are not prefabricated, or products that are clearly intended for a specific person, the statutory exception to the right of withdrawal may apply.
This means that you cannot automatically return a genuinely personalized product simply because, for example, you have changed your mind.
This exception does not affect your statutory rights where the product is damaged, defective, incorrectly personalized or otherwise not delivered in conformity with the agreement.
Specially made and personalized products are among the statutory exceptions to the normal 14-day cooling-off period.

8. Shipping and delivery
Our usual processing times before shipment are:
In-stock products: 1–3 working days
Personalized products: 3–5 working days
Party Keepsakes & bulk orders: 5–7 working days
The carrier’s delivery time is additional to this.
The available shipping methods, destinations and shipping costs are shown during the ordering process.
The stated processing times are not guaranteed delivery dates.
Do you need an order for a birthday, baby shower, party or another occasion on a specific date? Please order well in advance.

9. Right of withdrawal and returns
When you purchase a product online as a consumer, you generally have the right to withdraw from the agreement within 14 days after receiving the product, without giving a reason, unless a statutory exception applies.
For certain products made according to your specifications or clearly personalized, a statutory exception to the right of withdrawal may apply.
The conditions, exceptions, return procedure, return costs and refund information are set out in our Returns & Refunds Policy.
Consumers’ statutory rights remain fully applicable.
10. Statutory conformity
You are entitled to receive a product that conforms to the agreement and to what you may reasonably expect from it.
Is a product damaged, defective, incomplete, incorrectly personalized or incorrectly delivered? Please contact us at hello@livmakes.com.
Please include your order number where possible and, if relevant, clear photos of the product and packaging. This helps us assess the issue.
If a product does not conform to the agreement, you are entitled to the rights provided by law in that situation.
These rights are separate from the right of withdrawal.
11. Party Keepsakes, party packages and bulk orders
Party Keepsakes, party packages and other group or bulk orders may require a longer processing time.
Before ordering, carefully check:
> the number of participants or packages;
> the selected theme;
> any personalization;
> any name or age;
> any other selected options.
Where components of an order are produced according to your specifications or are clearly personalized, a statutory exception to the right of withdrawal may apply to those components.
Providing the date of a party or occasion does not mean that LIV MAKES guarantees delivery before that date, unless we have expressly agreed this with you in writing.
12. Personalized treats and food products
If LIV MAKES offers personalized treats containing food products, the relevant product, ingredient and allergen information will be provided in accordance with the applicable regulations.
Please check this information carefully before consumption, particularly where the recipient has a food allergy or intolerance.
Original product information on packaged food products must not be removed, covered or replaced where this information is legally required to remain available.
Food products must be stored and used in accordance with the information on the relevant packaging.
13. Share Your Creation
Through Share Your Creation, customers may voluntarily submit a photo of their LIV MAKES creation.
Submitting a photo does not automatically give LIV MAKES permission to publish it publicly or use it for marketing purposes.
If you separately give permission for promotional use, we may use the submitted photo within the scope of that permission, for example on our website or social media channels.
If identifiable personal data or images of children are submitted, the applicable privacy rules and the conditions stated in the upload form also apply.
You must be entitled to share the material you submit with LIV MAKES and must not infringe the rights of others.

14. Intellectual property
Content developed by LIV MAKES for the website and brand, including texts, logos, graphic design, original product photography, illustrations, product descriptions and packaging designs, may be protected by intellectual property rights.
To the extent that these rights belong to LIV MAKES, this content may not be copied, reproduced or commercially used without permission, except where permitted by law.
Third-party materials remain subject to the rights of their respective rights holders.
Purchasing a LIV MAKES product does not transfer any intellectual property rights relating to LIV MAKES branding or protected designs.
15. Reviews, photos and other contributions
When you voluntarily submit a review, comment, photo or other material to LIV MAKES, this content must not:
> be unlawful;
> infringe the rights of others;
> be misleading;
> contain discriminatory, threatening or otherwise unlawful content;
> contain malware or other harmful files.
Photos submitted through Share Your Creation are also subject to Section 13 and our Privacy Policy.
16. Website and availability
We do our best to keep the webshop functioning correctly and available. However, technical issues, maintenance or other circumstances may result in the website being temporarily unavailable or not fully available.
We may correct obvious typographical errors, technical errors and incorrect information on the website.
We may change, add or remove products from our range for future orders.
This does not affect statutory rights that you already have under an agreement that has been concluded.
17. External service providers
Our webshop uses third-party services, including Shopify and service providers for payments, shipping and technical functionality.
Where personal data is processed by such parties, this is done in accordance with our Privacy Policy and applicable privacy legislation.
The purchase agreement for products sold directly by LIV MAKES is concluded with LIV MAKES and not with Shopify.
18. Liability
LIV MAKES is liable to the extent required by applicable law.
To the extent permitted by law, LIV MAKES is not liable for damage caused solely by use that is clearly contrary to the usage or safety instructions provided with the product.
Nothing in these terms excludes or limits liability where such exclusion or limitation is not permitted under Dutch or European law.
These terms do not limit consumers’ statutory rights.
19. Privacy
We process personal data in accordance with our Privacy Policy and applicable privacy legislation.
To operate our webshop and fulfil orders, we may use service providers for services such as hosting, payments, shipping, forms and communication.
More information about which personal data is processed, for which purposes and with which parties data may be shared can be found in our Privacy Policy.

Where applicable, include your order number and describe your complaint as clearly as possible.
We handle complaints carefully and respond within a reasonable period.
This complaints procedure does not limit your statutory rights.
Please note: older webshop terms sometimes still refer to the European ODR platform. That platform closed on 20 July 2025, so this outdated reference should not appear in the LIV MAKES terms and conditions for 2026.
21. Applicable law and disputes
Agreements with LIV MAKES are governed by Dutch law.
If you are a consumer living in another EU country, this choice of law does not affect the protection you receive under mandatory provisions of the law that would apply to you in the absence of this choice of law.
Disputes may be submitted to the competent court in accordance with the applicable legal rules.
22. Changes to these terms
We may amend these terms and conditions if, for example, our products, services, webshop or applicable regulations change.
For an order, the terms that were applicable at the time the agreement was concluded will generally apply.
